Aaron Heck - Software License Procurement.
I've just been asked a question that I don't have a real answer for. We take advantage of HUP as one of our licensing benefits to allow users to get Microsoft Office at a greatly reduced price. Somewhere in the T's and C's it says that the user can install and use that version of Office at home as long as they are employed by us. So, the question is, if someone has bought Office through HUP and they (for whatever reason) are no longer employed by us then they should remove that copy of Office from their home PC. If they do not, who would Microsoft go after - the ex-employee or the company? I'm guessing the ex-employee. What's the definitive answer?
As i was just on there here are the T&C's from the Microsoft Licencing website: By clicking “I accept” below: (a) You represent that you are a Microsoft volume license customer with an active Software Assurance coverage for Microsoft Home Use Program (“MSHUP”) - eligible applications. (b) You acknowledge that: Your participation in MSHUP is subject to: (a) these MSHUP Terms & Conditions (as updated by Microsoft from time to time) and (b) the terms and conditions of your Microsoft volume license agreement. Microsoft software is licensed through MSHUP solely for the use of employees of Microsoft volume licensing customers participating in the MSHUP program An employee’s eligibility to license a given software title under MSHUP is conditioned upon (a) that employee’s status as a user of a licensed copy of the software within your organization, and (b) your enrollment of that copy in Software Assurance. Each of your eligible employees may order only one license per Microsoft software title.

Last Updated: 2006-11. I'm pretty sure it would be the former employee who is liable. The terms and conditions state that you (the end-user) accept that you have no right to use the software if you are no longer employed by a company with a volume licensing agreement or the company has cancelled/not renewed the software assurance for your work software. @Magnus - here in the UK the price you pay is conveniently labelled as a 'handling fee' so your not paying anything for the software itself (at least that's how it was when I used it). Thanks for that. So basically (if I'm reading it correctly), they're holding a sword over both the employee 'The End User License Agreement for the software licensed through MSHUP is an agreement between Microsoft and your employee. We will not hold you responsible for any individual employee’s failure to comply with the terms and conditions of that agreement.' And the employer 'We may terminate your participation in MSHUP immediately and without notice in connection with unauthorized access to or licensing through your personalized MSHUP website.' Matt stated this above: You acknowledge that your right to use Microsoft® software under an MSHUP license will expire upon the earlier of (a) termination of your employment with the volume licensing customer through which you gained access to MSHUP, or (b) the expiration or termination of Software Assurance coverage for the corresponding copy of the MSHUP – eligible desktop application that you use at work.
When you accept the T&C it will say that the agreement is between you (the end user) and MSFT. I just contacted Microsoft's toll free number after looking up their site at and spoke to Vette. Because I had a copy of Microsoft Office that I had paid extra to purchase the CD's while I was employed at a previous employer, I wanted to know if I could legally use it now that I was no longer employed by that employer. I told her I did not want to do anything wrong regarding licensing (thus the reason for my search and my call).
Microsoft Office For Military Program Code
She told me that since I had not installed it previously and since I had the original packaging with the license key, I had no need to worry, and that I could use the software. I thanked her, but having worked in the software licensing space in the past, had a nagging feeling that she could be mistaken. The reason I want to use the software is to help with my resume/job search, but I think after reading this thread It would be the right thing to do to download the trial version for 60 days to use during my job search as opposed to relying on the doubtful advice of that particular Microsoft call center employee.
